Jason Potts sentenced to 4.5 years work release for vicarious sexual gratification - victim under 14 years of age All other charges dropped in plea agreement By Sherri Sebella News Editor sherri@pressdispatch.net Jason Potts, of 48, of Pe- tersburg, was sentenced to four and one half years for the charge of vicarious sexual gratification (one of the victims must be under 14 years of age), with the other four charges of Child Solicitation - Solicitation is for intercourse. Defendant 18+ years old and the victim under 14 years of age, Child Solicitation, but Solicitation is to Engage in Fondling or Touch, and two charges of Possession of Child Por- nography, being dropped in a plea agreement between Potts and the Prosecutor's of fice on Monday, Septem- ber 19. According to Indiana Code § 35-42-4-5, adults who knowingly or intentionally in- str uct, direct, aid, include or, cause a child under the age of sixteen to fondle them- selves or another minor, with intent to arouse or satisfy the sexual desires of a child or the adult can be charged with vicarious sexual gratifi- cation. Potts must also register as a Sex Of fender for 10 years and pay a $75 fine plus cour t costs, within 90 days or as or- dered by the Cour t. "Typically what happens is we tr y to get things resolved for the highest charge and the other charges are dismissed," Sarah Christianson, Chief Deputy Prosecuting Attorney, said. "It would have been the same charges for the others. Depending on the nature of the case, it's not uncom- mon for someone to plea to the highest level charge and the others are dismissed via plea agreement." Potts will ser ve his time in the work release program at the Wabash Valley Region- al Community Corrections Work Release Program or a like facility, and an ankle monitor is also required for Potts to wear according to the Prosecutor's Office.
