CITY OF PETERSBURG ORDINANCE 2022-1 AN ORDINANCE AMENDING TITLE 9, Chapter 9.33, SECTION 9.33.030 OF PETERSBURG MUNICIPAL CODE, CON- CERNING THROUGH COMMERCIAL TR AFFIC and THE FINES ASSESSED FOR VIOLATION. WHEREAS, the Common Council already determined, upon advice from INDOT, that there were certain streets that were designat- ed as local detours for the work presently tak- ing place on Indiana State Road 61, and these detours were added in 2021 to the list of those streets that were not suitable for through com- mercial truck traffic; and, WHEREAS, all streets so determined and added in 2021 to Code Section 9.33 as not be- ing suitable for commercial traffic are experi- encing violations and additional measures are needed to assure compliance; and, WHEREAS, the fine listed in 9.33.030 is $100, and this is not providing enough de- terrence to prevent the use of the restricted streets by commercial traffic. NOW, THEREFORE, TITLE 9, Chapter 9.33, SECTION 9.33.030 is amended to provide the following fines for commercial trucks that violate the "through" traffic pro- hibition: UP TO $500 fine for first offense; UP TO $1000 fine for second and subsequent offenses by the same driver. This ordinance shall be effective after its due publication and posting of signs on said streets.
