The Press-Dispatch Wednesday, December 29, 2021 D-7 LEGAL NOTICE REQUEST FOR RELEASE OF BOND Sun Energy Group, LLC has filed a request with the Indiana Department of Natural Resources, Division of Reclamation, for the release of a portion of performance bond posted to ensure reclamation of the Hilsmeyer #2 Mine, Permit #S367, which was approved by the Natural Resources Commission on 5/22/2011. e request includes 3.3 acres for grading, Phase I 60% release, 3.3 acres for revegetation, Phase II 25% release and 17.9 acres for final, Phase III 15% release. e request area is part of 511.8 acres permitted in Sec.'s 4, 5, 8, 9, & 16, T3S, R6W, and Sec. 32, T2S, R6W, in Pike County. e proposed request is for partial release of Phase I, Phase II, and Phase III reclamation liability totaling $25,695.60 of the remaining $29,255.97 currently held by the Division of Reclamation for the above permit. is request is being made pursuant to Indiana Code 14-34-6-7 and IAC 312 25-5-16. SUDOKU ORDINANCE NO. 2021-13 AN ORDINANCE OF PIKE COUNTY, INDIANA, CONCERNING THE PROHIBITION OR WEIGHT RESTRICTION FOR HIGHWAY VEHICLES FROM JANUARY 1, 2022 TO MARCH 31, 2022 ON CERTAIN PIKE COUNTY HIGHWAYS WHEREAS, the State of Indiana has provided for certain local regulation of county highways pursuant to I.C. 9-20-1-3. WHEREAS, county highways may, by reason of deterioration, rain, snow, or other climatic condition be seriously damaged or destroyed unless the use of vehicles is prohibited or permissible weight is therefore reduced; BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF PIKE COUNTY, INDIANA; SECTION 1. is ordinance shall apply to all highways under the jurisdiction of the Board of Commissioners, except highways in the state highway system and state maintained routes through cities and towns. SECTION 2. Vehicles shall be restricted on the following highways in Pike County, Indiana from January 1, 2022 to March 31, 2022, all roads with a posted weight limit. SECTION 3. e weight of vehicles operated on highways and covered by Section 2 above in Pike County, Indiana from January 1, 2022 to March 31, 2022 shall be restricted as follows: weight limit as posted on each respective road. SECTION 4. It shall be unlawful for any person to operate or move or for the owner to cause or knowingly permit to be operated or moved upon any public highway in this county covered by Section 2, any vehicle or combination of vehicles of a weight exceeding the limitations established by Section 3 of the Ordinance. SECTION 5. A person found to have violated this Ordinance shall be fined a maximum of Twenty-five Hundred dollars ($2,500.00) per violation. e Court may consider ordinary mitigating and aggravating factors in determining the fine. SECTION 6. is Ordinance shall not be effective until and unless signs are erected and maintained designating the prohibitions and limitations of this Ordinance at each end of that portion of the highway affected thereby and at intersecting highways. SECTION 7. If any section, part of section, or part of this Ordinance shall be declared unconstitutional, unlawful, or void, it shall not affect the validity or force of any other section, part of section or parts of this Ordinance not so declared to be unconstitutional, unlawful or void. SECTION 8. All Ordinances, or part of Ordinances, or resolution or orders or parts thereof, in conflict with provision of this Ordinance to the extent of such conflict are hereby expressly rescinded and repealed.
