Mechanical Installation, Labor, Materials, Tools, Equipment, Permits, Licenses, Insurance, Service Costs, and so forth incidental to and required for the Project. Pre-Bid Conference A pre-bid conference will be held at 10:00 A.M., local time, on November 24, 2021 at the City of Petersburg City Hall located at 704 East Main Street, Petersburg, Indiana 47567. Attendance at the pre-bid conference is highly encouraged but is not mandatory. All prime contractors, subcontractors, small minority, or women owned enterprises and other interested parties are invited to attend. Instructions to Bidders For all further requirements regarding bid submittal, qualification, procedures, and contract award, refer to the Instructions to Bidders that are included in the Bidding Documents. Bid security shall be furnished in accordance with the Instructions to Bidders. Bidders shall submit proof of qualifications to perform the Work as described in the Instructions to Bidders. American Iron and Steel Section 746 of Title VII of the Consolidated Appropriations Act of 2017 (Division A–Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2017) and subsequent statutes mandating domestic preference applies an American Iron and Steel requirement to this project. All listed iron and steel products used in this project must be produced in the United States. e term "iron and steel products" means the following products made primarily of iron or steel: lined or unlined pipes and fittings, manhole covers and other municipal castings, hydrants, tanks, flanges, pipe clamps and restraints, valves, structural steel, reinforced precast concrete, and construction materials. e deminimis and minor components waiver apply to this contract. All iron and steel products used in this project must be produced in the United States. Bonding Requirements Approved performance and payment bonds guaranteeing faithful and proper performance of the work and materials, to be executed by an acceptable surety company, will be required of the Contractor at the time of contract execution. e bonds will be in amount of 100% of the Contract Price and must be in full force and effect for a period of twelve (12) months from the date of acceptance and final payment for the work. Each proposal must be enclosed in a sealed envelope bearing the title of the Project and the name and address of the Bidder. All proposals must be submitted on the proposal forms as identified in the Contract Documents and Drawings. Each proposal shall be accompanied by a certified check or acceptable bidder's bond made payable to OWNER, in a sum of not less than five percent (5%) of the total amount of the highest aggregate proposal, which check or bond will be held by OWNER as evidence that the bidder will, if awarded the Contract, enter into the same with OWNER upon notification from him to do so within ten (10) days of said notification. Award of Contract OWNER reserves the right to reject any proposal, or all proposals, to accept any proposal or proposals, or to make such combination of proposals as may seem desirable, and to waive any and all informalities in bidding. Any proposal may be withdrawn prior to the above scheduled time for the opening of proposals or authorized postponement thereof. Any proposal received aer the time and date specified shall not be considered. NO proposal may be withdrawn aer the scheduled closing time for receipt of bids for at least ninety (90) days. A conditional or qualified Bid will not be accepted. Award will be made to the low, responsive, responsible bidder. e low, responsive, responsible bidder must not be barred, suspended, or otherwise be excluded from or ineligible for participation in federally assisted programs under Executive Order 12549. All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the Project shall apply throughout the Project. Proposals shall be properly and completely executed on Indiana Form 96, included in the Specifications. Under Section III of Form 96 the bidder shall submit a financial statement. OWNER may make such investigations as deemed necessary to determine the ability of the bidder to perform the work, and the bidder shall furnish to OWNER all such information and data for this purpose as OWNER may request. OWNER reserves the right to reject any bid if the evidence submitted by, or investigation of such bidder fails to satisfy OWNER that such bidder is properly qualified to carry out the obligations of the Agreement and to complete the work contemplated therein. Each bidder is responsible for inspecting the Project Site and for reading and being thoroughly familiar with the Contract Documents and Drawings. e failure or omission of any bidder to do any the foregoing shall in no way relieve any bidder from any obligation in respect to its bid. is project will be partially funded with Federal funds from the United States Department of Commerce, Economic Development Administration 06-79-06190 and the US Department of Agriculture therefore is subject to the Federal laws and regulations associated with these agencies. Neither the United States nor any of its agencies will be a party to this Advertisement for Bids or any resulting contract.
