Domestic dispute results in numerous drug-related charges By James Capozella A call to central dispatch from Allison Doane, 34, of 4 Canterbury Ct., Jasper, re- garding a physical alterca- tion resulted in her arrest and that of Kelly Birkle, 47, of 9 S. SR 275, Velpen. Do- ane called dispatch from Otwell to report a domestic with Kelly Birkle on Thurs- day, June 28. When Sher- iff Deputy Jared Simmons spoke with Doane, he re- ported noting a scrape on her knee, the odor of an al- coholic beverage, slightly slurred speech, and fixed and dilated pupils, indicat- ing methamphetamine in- toxication. His report al- so states Doane was mov- ing her jaw in an irregular manner and she was fidgety. Doane told Simmons she believed Birkle was dealing methamphetamine and she showed him a desk in the garage where Birkle was "cutting it up." Simmons re- ported seeing a crystal-like substance, a small ziplock baggie that also contained a crystal-like substance. The baggie also had eight balls on it, plus a snort tube with residue. These items field tested positive for metham- phetamine. Asked if she had seen Birkle use methamphet- amine recently, Doane stat- ed that she had used meth with him earlier that day. She also stated he was us- ing needles to "Shoot dope." Simmons contacted Pike County Prosecutor Dar- rin McDonald and after statements to Judge Bies- terveld, probable cause was established and a search warrant was obtained. Sgt. Chad McClellan responded to the residence when Sim- mons learned that Birkle was coming back from Jas- per. Birkle's mother arrived at the residence and wanted Doane removed, stating Do- ane had attempted to stab Birkle. According to the report, Birkle denied that anything physical had happened, but then stated Doane had a knife he took from her be- cause she had been acting crazy and had cut herself in the past. The report said he stated he never pushed her down and didn't want her to get in trouble, but to just to leave. During the search of the living quarters, there was residue on several surfaces, used hypodermic needles, baggies and torch lighters used to smoke meth. During a search of Birkle's truck, a WD-40 can that Doane had spoken about earlier was found. It had a false bot- tom, but was empty. There was also a smoking glass and baggies containing schedule II amphetamine pills and several schedule IV Xanax bars, according to the report. Birkle was arrested for possession of methamphet- amine under 5 grams, un- lawful possession of a sy- ringe (prior), possession of paraphernalia (prior), main- taining a common nuisance, possession of schedule I, II, III or IV controlled sub- stance and domestic battery. Doane was arrested for possession of methamphet- amine under 5 grams, un- lawful possession of a sy- ringe, possession of mar- ijuana, visiting a common nuisance, possession of paraphernalia and domes- tic battery.
