WHEREAS, county highways may, by reason of deterioration, rain, snow, or other climatic condition be seriously damaged or destroyed unless the use of vehicles is prohibited or permissible weight is therefore reduced; BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF PIKE COUNTY, INDIANA; SECTION 1. is ordinance shall apply to all highways under the jurisdiction of the Board of Commissioners, except highways in the state highway system and state maintained routes through cities and towns. SECTION 3. e weight of vehicles operated on highways and covered by Section 2 above in Pike County, Indiana from January 1, 2018 to March 31, 2018 shall be restricted as follows: weight limit as posted on each respective road. It shall be unlawful for any person to operate or move or for the owner to cause or knowingly permit to be operated or moved upon any public highway in this county covered by Section 2, any vehicle or combination of vehicles of a weight exceeding the limitations established by Section 3 of the Ordinance. SECTION 5. A person found to have violated this Ordinance shall be fined a maximum of Twenty- five Hundred dollars ($2,500.00) per violation. e Court may consider ordinary mitigating and aggravating factors in determining the fine. SECTION 6. is Ordinance shall not be effective until and unless signs are erected and maintained designating the prohibitions and limitations of this Ordinance at each end of that portion of the highway affected thereby and at intersecting highways. SECTION 7. If any section, part of section, or part of this Ordinance shall be declared unconstitutional, unlawful, or void, it shall not affect the validity or force of any other section, part of section or parts of this Ordinance not so declared to be unconstitutional, unlawful or void.
