Pike County sheriff deputy Kane Os- gatharp investigated the complaint and made the arrests. Charges for James Hays, 69, 1573 arthur Church rd., Winslow and Bret nelson, 63, 1719e McCoy st, Petersburg, stem from a call to central dispatch from Heath Morton who had photos of men stealing things including a gate at the property. Morton reported the two men were there on november 23, november 29 and december 13, 2022. Morton's Face- book posting and his conversation with Hays helped identify James Hays and Bret nelson, according to Osgatharp's probable cause affidavit. The photos showed two men taking down the gate and loading it. Hays first agreed to talk with deputy Osgatharp on december 29 and then declined and wanted to get an attorney. nelson had said they got the gate down the highway, down some back roads but didn't know where. nelson said the gate was taken back to the property. nelson had reportedly post- ed an apology on Facebook and in an interview with deputy Osgatharp said he didn't think anything of it and that there was nothing to steal. Indi- ana state Trooper Boeckman assisted simmons in the stop while unloading the shotgun. simmons noticed a tied corner bag and a ziplock sandwich bag, both with a crystal-like substance lying on the floorboard next to where the shotgun was found. When asked what the bags con- tained, stelling said that "you can see it, man."
