NOTICE TO BIDDERS GENERAL Notice is hereby given that separate sealed bids will be received by the City of Petersburg, Indiana until 4:00 pm local eastern time on August 19, 2019 at the Petersburg City Hall, 704 E. Main Street, Petersburg, Indiana 47567 for the following work: Partial Clearance, Removal of Environmental Conditions and Support of façade and support of adjacent building walls 606/608 Main Street, Petersburg, Indiana 47567 Bids received aer this time will be returned unopened. Each Bid must be enclosed in a sealed envelope bearing the title "Petersburg Clearance Project" and the name and address of Bidder. Lump Sum Bids will be received from General Contractors for the project as shown on the Drawings and hereinaer specified and as set forth on the Contractors Bid Form to be constructed in one single prime contract. Findings and conclusions of all of this report completed, regarding asbestos inspection and lead-base paint inspection are contained in the assessment and can be received from the Architect by requesting a copy by email at adchenson@twc.com. e work for which bids are requested includes all labor, materials, equipment and items of materials and services required to provide the proper and complete construction of this project. e work shall be constructed in accordance with this Notice to Bidders, Project Manual, Drawings and Addenda, as prepared for this project. Each bidder is responsible for inspecting the Project site and for reading and being thoroughly familiar with the contract documents and specifications. e failure or omission of any Bidder to do any of the foregoing shall in no way relieve any Bidder from any obligation with respect to its Bid. e work to be performed and the bid to be submitted shall include sufficient and proper sums for the structure partial demolition, waste management, and certified disposal, labor, materials, permits, licenses, insurance, and so forth incidental to and required. Bid and Bid Guarantees shall be placed in sealed envelopes and addressed to the Owner, the City of Petersburg, and shall list the name and address of the Bidder. Should any Bidder withdraw his bid or bids within 90 (Ninety) days aer the time of Bid Opening or if issued a Letter of Intent, withdraw his bid or bids aer the issuance of such Letter of Intent, or fail to execute a Form of Agreement if presented, the Owner may declare the Bid bonds forfeited to the Owner as liquidated damages. e Owner reserves the right to (1) accept any bids by a Letter of Intent within 90 (Ninety) days aer the time of Bid Opening and a presentation of a Form of Agreement within 90 (Ninety) days from the date of such Letter of Intent (2) at any time reject all bids and (3) waive all informalities, irregularities, or errors in the bidding, provided it is not in violation of the Notice to Bidders or the Statutes of the State of Indiana. A conditional or qualified bid will not be accepted. Bidders not issued a Letter of Intent will have their Bid Guarantees returned within seven (7) days aer the issuance of the Letter of Intent. Bid Guarantee: Each bid shall be accompanied by a certified check, cashier's check, money order or a satisfactory bid bond executed by the bidder and an acceptable surety, payable to the City of Petersburg, in an amount equal to 5% of the maximum bid. e attorney-in-fact who executes the Bond on behalf of the Surety shall affix to the Bond a certified and current copy of his Power-of-Attorney. Bids shall be executed on Indiana State Board of Accounts Form No. 96 with Non-Collusion Affidavit, with all sections completely filled in and sworn to as required by the Statutes of Indiana for all bids. All prices quoted, are to be free of all Federal Excise Taxes and State Sales Tax, and upon request of supplier, tax exemption certificate will be executed by the Owner to the successful bidder to cover all items subject to this tax. Contractors receiving awards shall furnish an approved Performance Bond, Labor and Material Payment Bond for 100% of the contract which shall be in full force and effect for 12 months from date of acceptance of work. Bonds shall be furnished at time of written notice to proceed with the work. A Pre-bid conference will be held at the Petersburg City Hall, 704 E. Main Street, Petersburg, Indiana at August 7, 2019 at 10:30 am local time. All prime contractors, subcontractors, small, minority or women owned enterprises and other interested parties are encouraged to attend. Representatives of the Owner and Architect will be present to discuss the project. e building will be open for review on that day. Award will be made to the low, responsive, responsible bidder. e low, responsive, responsible bidder must not be debarred, suspended, or otherwise be excluded from or ineligible for participation in federally assisted programs under Executive Order 12549. All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the project throughout. Davis Bacon Wage rates do not apply to the project. Bidders on this work shall be required to comply with the provisions of the President's Executive Order No. 11246, as amended. e Bidders shall also comply with the requirements of 41 CFR Part 60–4 entitled Construction Contractors– Affirmative Action Requirements. A copy of 41 CFR Part 60–4 may be found in the Supplemental General Conditions of the Contract Documents and Specifications. e Bidders attention is also called to the "Minority/Women Business Participation" requirements contained in the Project Specifications. e Indiana Office of Community and Rural Affairs has adopted a State goal of 10% participation for minority and women owned businesses for construction related or purchase related contracts for the work. e Contractor must meet guidelines and practices established by the Indiana Office of Community and Rural Affairs and appropriate federal regulations including: 1) Executive Order 11246, 2) Section 3 of the Housing and Community Development Act of 1968, as amended, 3) Certification of Non-Segregated Facilities, 4) OMB Circular A-102, 5) Title VI of the Civil Rights Act of 1964, 6) Section 504, Rehabilitation Act of 1973, 7) Age Discrimination Act of 1975, 8) Executive Order 12138, 9) Conflict of Interest Clause, 10) Retention and Custodial Requirements for Records Clause, 11) Contractors and Subcontractors Certifications, and others that may be appropriate or necessary. Contract procurement is subject to the federal regulations contained in the OMB Circular A-102, Sections B and O and the State of Indiana requirements contained in IC-36-1-9 and IC-36-1- 12.
