Terry Davis and Connie Davis do not appear (and are known to both be deceased) for this hearing, but an heir of Terry Davis (who died first) does appear, and evidence is presented by Ross Elmore, Petersburg Building Commissioner, and the Enforcement Authority under Petersburg Municipal Code, Title 14, Chapter 14.24 concerning Unsafe Buildings. Based upon the evidence presented by the Enforcement Authority, this Hearing Officer finds that the Order of Enforcement Authority Ross Elmore, dated June 15, 2018, and served upon Terry Davis and Connie Davis by publication, ought to be affirmed. is Hearing Officer further finds that the estimated cost of the work required by the Order of the Enforcement Authority will be less than $10,000.00. is Hearing Officer therefore affirms the Order of the Enforcement Authority as follows: Due to its current condition the mobile home residence on the property at 626 S 5th Street, Petersburg, Indiana, must be torn down and demolished, along with any other buildings on the property, and the debris must be removed and the lot cleaned up. Any interested person must accomplish the above action within 30 days of the date (or 30 days aer second publication whichever is later) of this affirmation of Order and if not done, then City of Petersburg, Indiana, acting through its Enforcement Authority and Building Commissioner, Ross Elmore, is authorized to perform the work with its own equipment and its own workers, pursuant to IC 36-7-9-11; or to let a contract for the work to a licensed contractor, aer public bidding, as provided by law. e Enforcement Authority shall give notice to Terry and Connie Davis of this affirmation of the Order of the Enforcement Authority as required by IC 36-7-9-11, and in the manner prescribed by IC 36-7-9-25.
