Looking at the full gamut of what is on the docket in the years ahead, Neitzke said of dark stores legislation, "This is one of the biggest issues we are facing right now." The dark stores talk began a few years ago as a number of national big box and mid-size retailers have sought lowered assessments on their properties when they are near vacant build- ings. Lawyers representing the retailers have argued the compa- nies have been paying above-mar- ket figures. Wisconsin Manufacturers & Commerce has been among the trade groups favoring tighter con- trols in how retail properties are assessed. Efforts to reach a repre- sentative within the organization by press deadline were not suc- cessful. Some municipalities across the state have already been sub- jected to legal action against retailers invoking provisions that might be incorporated into dark stores legislation. Wauwatosa, which has seen new growth in and near Mayfair Mall, is among the municipalities. Mayor Kathy Ehley said Wauwatosa has incurred $450,000 in legal expenses this year, in part resulting from a lawsuit grocer Meijer filed against the city. Wauwatosa was one of the first communities to host a Meijer as the Michigan-based grocer has made a push into Wisconsin. "We can't let our guard down," Ehley said of the issue. Municipalities band together During this week's discussion, Neitzke and other municipal lead- ers said they believe it would be prudent to be vocal about the issue in the months ahead — par- ticularly as taxes are fresh in the minds of the residents who make voting decisions within specific municipalities. Plans call for holding a news conference — potentially on a sidewalk or other public property — in front of one of the retailers that has used the dark stores argument to have a lower assess- ment at the next ICC meeting Dec. 11. Milwaukee Mayor Tom Barrett also suggested municipal leaders head to Madison in January to share grievances over the bill and how it would impact area commu- nities. "I think there's strength in numbers," Barrett said.
