This Ordinance will establish a schedule of service charges for residential property which will be collected along with the County's property taxes and will become a lien on the property, if unpaid. The Board of Supervisors will also consider a report filed by the Public Works Department titled "Lost Hills Universal Solid Waste Collection Charges for Fiscal Year 2020-2021." Issues and recommendations in the report include the following: 1. Designate the use of each parcel of real property in the Lost Hills Universal Collection Area as residential with four units or less, residential with more than four units, or non-residential; 2. Describe the amount of the proposed service charge for each parcel of real prop- erty with four residential units or less in the Lost Hills Universal Collection Area should the proposed Ordinance be enacted and the report approved; and 3. Maximum annual rates for universal solid waste collection for Fiscal Year 2020- 2021 in the Lost Hills Universal Collection Area are set forth in the following table for residential properties with four units or less. This maximum rate includes the Solid Waste Administration fee which is charged on an account basis per provisions in County Ordinance and contracts with the individual haulers. In some instances, this maximum rate may be slightly lower per unit based on the number of accounts actually served on that property. Any affected person may submit written protests to the report or the enactment of the proposed tax roll billing. Written protests must be signed by the objecting party, indicate the subject property and be delivered to the Clerk of the Board of Supervi- sors prior to the conclusion of the public hearing. Upon the conclusion of the hearing, the Board of Supervisors may adopt, revise, change, reduce or modify any charge set forth in the report filed by the Public Works Department or overrule any or all objections, and shall make its determination upon each charge as described in that report. Should the owners of either a majority of the separate parcels of real property or a majority of the separate parcels of resi- dential real property described in the report object to the report, the report will not be adopted and the charges for residential real property described in the report will not be collected with the County's property taxes; otherwise, the Board of Supervi- sors may order the report filed with the Auditor-Controller-County Clerk, who will enter the amounts of the charges against the respective parcels of residential real property as they appear on the assessment roll. The Director of the Public Works Department has considered the environmental im- pacts of this action and concluded that this action will not have a significant effect on the environment and the action is statutorily exempt from further CEQA review per Public Resources Code Section 21080(b)(8) and Sections 15061(b)(3) and 15273 of the California Environmental Quality Act Guidelines. The charge imposed on a parcel of property used as a single-family residence will remain at $82.89 per unit for one to four unit residential parcels and $66.30 per unit for a five or more unit residential parcel. The service charges for waste generated on non-residential properties will not be collected on the tax roll but instead, will be paid through Gate Fees or Bin Fees, as appropriate. This Ordinance also establishes that the same fee will be paid on an account basis for all residential properties that are not located in a Universal Collection Area that subscribe to the services of a franchise hauler and all commercial properties that subscribe to the services of a franchise hauler. The Board of Supervisors will also consider a report filed by the Public Works Department that describes the amount of the proposed fee for each franchise hauler account should the proposed Ordinance be enacted and the report ap- proved. In accordance with this report, the Public Works Department sets the Solid Waste Administration Fee at $0.20 per hauler account per month for Fis- cal Year 2020-2021. The fee for waste generated on non-Universal Collection Area residential and commercial properties that subscribe to the services of a franchise hauler will not be collected on the tax roll but instead, will be invoiced to the franchise hauler annually by the Public Works Department. Any affected person may submit written protests to the report or the enactment of the proposed tax roll billing. Written protests must be signed by the object- ing party, indicate the subject property and be delivered to the Clerk of the Board of Supervisors prior to the conclusion of the public hearing.
