When Mayes was told bottles from his home may have been used to make the Molotov cocktails, he said he drinks the same brands of beverages and said his DNA would be on them as they were his, the complaint said. Investigators also talked to four individuals who con- nected Mayes to the bottles. One said he or she heard Mayes saying that "Sylville Smith needs justice," and saw Mayes filling Molotov cocktails at the apartment, using the same brand of bot- tles police found and dip- ping ripped cloth in gasoline before loading the bottles. Another said he or she was asked to throw rocks while others bombed the police station, the complaint said. The informant said as many as 20 people met at the Sherman Boulevard apart- ment Aug. 15, 2016, to dis- cuss a plan to firebomb the police station at 3626 W. Fond du Lac Ave., a few days after the rioting, the com- plaint said. The informant "stated that s/he and others drove by the police station located at 3626 W. Fond Du Lac Ave. and saw police on the build- ing's rooftop. (The inform- ant) and the others went back to (the apartment) and told the others that the police were ready for them," the complaint said. "(B)ecause of the heavy police presence, the group decided against attacking the police station that night." Mayes' own recordings incriminated him, the com- plaint said, with videos depicting rioters damaging a police car and another showing him saying, "Where the rocks at? Who got the rocks?" as a group confronted a line of police officers Aug. 13, 2016. A video posted to Facebook early Aug. 14, 2016, showed Mayes saying the Milwaukee rioting "(T)urned into Baltimore. It turned into Ferguson. And it was necessary," apparent references to riots that fol- lowed deaths during police contacts in those cities. In a Facebook message to what was believed to be his sister, Mayes said things were "bout to get real tonight." A spokesman for the Program the Parks group could not be found before press time this week. Anderson Gansner, who appeared with Mayes in court Monday, said he had no substantive comment and expected Mayes would get a different attorney ahead of his Thursday court appearance. If convicted of all the charges, Mayes faces as much as 60 years in prison, with 35 of them mandatory, according to the complaint. "Today's charges are the result of ongoing efforts to hold accountable those who engaged in criminal con- duct during the Sherman Park riots," U.S. Attorney Matthew D. Krueger said in a news release. The release added ATF agents are conducting mul- tiple investigations into the riots. Following the shooting, Heaggan-Brown was acquit- ted of reckless homicide charges in Smith's death, but was convicted of other crimes in an unrelated case. Mayes: Up to 20 people met in firebombing plot, informant says continued from Page 1 Conley News Service WAUKESHA — A Milwaukee man who sup- plied the heroin that killed a Town of Vernon man last year lost his bid to withdraw his plea in the case June 29. Montrell Washington, 26, was convicted of second- degree reckless homicide as party to a crime after plead- ing guilty to the charge in January, a year after he sup- plied the heroin that con- tributed along with alcohol to the death Kyle Demski of the Town of Vernon. But within a month of entering the plea, Washington sought to with- draw it, saying in his motion he was promised that pending charges in Milwaukee County would be dropped if he entered a plea agreement and they weren't. He said defense lawyer Thomas Harris told him to take the deal or Harris would no longer rep- resent him, that Harris told him he was "dumb" to take the case to trial and to just "take the deal cause (he was) guilty. ... I did not vol- untary plead guilty," Washington wrote in a motion to withdraw his plea. "I was rushed into signing papers and just went along to please (Harris)." Within a week of Washington filing his motion, Harris withdrew from the case and Washington was appointed a new lawyer, court records show. After a hearing on the matter, Judge Lee S. Dreyfus Jr. denied Washington's request to withdraw his plea, as he had not shown a "just or fair reason for with- drawal," court records indi- cate. Washington is to be sen- tenced July 20.
