LiftMaster $359 (reg. $369) $329 (reg. $339) 242964017 By Matt Masterson Freeman Staff WAUKESHA — A petition from the Town of Brookfield, seeking to incorporate the municipality into a village through the annexation of nearly 300 acres of Town of Waukesha land, was official- ly dismissed in Waukesha County Circuit Court last month. The decision ended the Town of Brookfield's third attempt to become a village after a petition was filed ear- lier this year by town resi- dent and Vice President of American Entrances of Wis- consin, Inc., Jay Walt. "While disappointed with the circuit court ruling, we respect and understand the reasoning behind it," Walt told The Freeman. "At this time the town has not made a decision as to whether we will pursue this in the future." Court records indicate Town of Brookfield Attor- ney James Hammes asked the circuit court to hold the case in abeyance for six months and review it again at that time. But his request, and the petition, were denied. The Brookfield Town Board has since met in closed session with its legal counsel "regarding strategy to be adopted in the incorpo- ration proceedings." Town Administrator Rick Czopp was out of the office and did not respond to a message left by The Freeman. In May, Wisconsin's seven- member Incorporation Review Board held a six- hour public hearing at Brookfield Town Hall. Repre- sentatives from the Town and city of Waukesha and the city of Brookfield pre- sented their case against the petition, along with several vocal Town of Waukesha res- idents who also spoke out against the proposed move. Last month the board issued a ruling stating the town had not satisfied half of its six statutory standards needed to move the incorpo- ration process forward. That decision was upheld by Circuit Court Judge Maria Lazar last month. "With the circuit court's dismissal of the incorpora- tion petition," Waukesha Town Chairman John Marek said, "the Town of Wauke- sha has been vindicated in its opposition to the incorpo- ration that included the tak- ing of some 288 acres of Town of Waukesha land." Marek said he would encourage the Town of Brookfield to continue pur- suing incorporation efforts, as long as it does not include Town of Waukesha lands. The Town of Brookfield sought to annex the acreage from the adjacent Town of Waukesha to meet a four- square-mile requirement to be classified as a village under state law. The IRB ruled the loss of land would likely be inconse- quential to the Town of Waukesha due to its size and the fact that it is already physically cut off from the rest of the town. But the board was more concerned about what would happen to the remnant Town of Brook- field that would be left behind by the proposed vil- lage. "The situation for the remaining Town of Brook- field is more problematic because of the small and physically scattered rem- nant with its low population and resulting equalized value," the IRB said in its decision. "Comparing its current and expected rev- enues against its predicted and potential liabilities, incorporation could nega- tively impact the remaining town and its residents." In addition, the board felt the Town of Brookfield's petition failed to show how the Town of Waukesha land would be "compact and homogeneous" to the pro- posed village, and couldn't prove the incorporation wouldn't negatively affect the surrounding community. Protecting borders During the May hearing, Waukesha Mayor Shawn Reilly, Community Develop- ment Director Jennifer Andrews and Water Utility General Manager Dan Duch- niak each spoke out against the incorporation effort, cit- ing, among other things, the Town of Waukesha land's location in the city's water district. But Marek believes that opposition came from the city's own desire to acquire the land in the future. "The city of Waukesha absolutely was working in their own interest and not in the interest of the Town of Waukesha," he said, "and now it is time for the Town of Waukesha to begin seeking alternatives to protect our own borders." Marek was not yet willing to share his plans for protect- ing the land publicly. During a recent Waukesha Common Council meeting, City Attorney Brian Run- ning called the review board's decision a "good thing for the city of Wauke- sha." Assistant City Attorney Julie Gay — who was involved in organized the city's presentation at the IRB meeting — said the city had no comment on the ruling. She did say the city current- ly has no specific plans in place for the Town of Wauke- sha land and residents there would need to petition the city in order for any annexa- tion to occur. "We don't unilaterally go out and acquire property or have a plan for a piece of property until it is within our jurisdiction," she said. City Lights Design Showroom was acquired by Ferguson last October. According to an announcement, the facility was built as environmentally friendly as possible using the Trachte Building System to help pro- mote the sustainability of the area through the use of energy efficient and reusable materials.
