Wipes tears when he hears son's recording By BRIAN HUBER Conley News Service WAUKESHA — A Milwaukee man whose son called 911 because he couldn't wake up his passed-out father last January was sen- tenced to a year in prison Jan. 18. Conley News Service is not naming the man, 34, to protect the identity of his chil- dren. But he pleaded guilty Jan. 18 to a count of operating while intoxicated, third offense, with a minor in the vehicle, and a count of child neglect in a plea agreement that dismissed two other such charges of neglect and operating while revoked. He was sentenced by Circuit Court Judge Michael Aprahamian to serve one year in prison, with 82 days credit granted for time served, as well as a year on supervision after that for the OWI charge, and two years' probation following that for the child neg- lect charge. The man was charged last January after his 8-year-old son called 911 to report he was afraid his father was dead because he could- n't wake him up when they were parked outside the school district offices on Maple Avenue. The man wiped away tears as a portion of the 911 call was played in which the child said he feared "(his) dad's dead. He's not waking up for anything." The man reportedly picked his children up from school, went to the school district office and sat there in his car for nearly two hours before the child called police, the complaint said. An officer tried waking the man, first by shouting and then slapping him in the chest about 15 times before he came to, the com- plaint added. Rescue workers administered Narcan, the complaint said. Assistant District Attorney Melissa Zilavy said the man had snorted Xanax ear- lier in the day and also had morphine in his system. She said three weeks earlier the man had got off probation for a previous offense of operating while intoxicated with a minor in the car. In that incident, his three children were with him. "They rely on him to protect them and he completely failed at that," she said. Public defender M. Elizabeth Weathers said her client "did something stupid" that day, but he didn't take drugs — he bought crushed pills of an unknown substance, she said — in front of them.
