The proposal, which would strengthen enforcement against encroachments onto the nearly 200 paths, is part of a conditional settlement agreement announced this week. It is contingent upon City Coun- cil approval. The meeting bit. ly/2nsTMNl is at 6:30 p.m. Monday at City Hall, 26 Corte Madera Ave. The lawsuit against McCann, filed in October by a former city planning commissioner and long- time trail advocate Victoria Talkington, alleged that he failed to preserve and protect the city's recreational and emergency evacuation routes. If the council approves the resolution, the city will pay a portion of the plaintiff's attorney fees in the amount of $95,000. And "the plaintiff will dismiss the lawsuit with prejudice," meaning it will be a closed case, City Attorney Gregory Ste- panicich said. In total, the city would be paying more than $198,800 in combined legal fees and costs on the case.
