Regional Advertising Director – Southeastern Indiana Media, a growing print and digital media company, seeks an experienced regional advertising director for its three newspapers: the Greensburg Daily News, the Rushville Republican and the Batesville Herald-Tribune. The advertising director develops and executes marketing strategies across multiple platforms to maximize sales and enhance our market share. This person works with the regional publisher to ensure profit- ability by meeting revenue and expense targets. We expect an executive who quickly spots trends and adjusts to maximize gains or minimize losses. Candidates must also know how to develop revenue opportunities through retention and consultative selling. Our advertising director will lead a staff of six multimedia account executives and oversee direct sell- ing for major advertisers and key affiliations. We expect a skilled leader who can train, recruit and develop a committed sales and marketing organization. Mentoring, field coaching and prospecting are key aspects of this position. Exceptional leadership, marketing and communication skills are vital for this role. Candidates should have at least eight years of sales or sales management experience in print and digital media. This person must be proficient with Microsoft Office. Experience with display ad serving technologies is a plus. Effective July 1, the APRA includes in its definition of "public agency" a private uni- versity police department. [I.C. 5-14-3-2(q)(11)]. The law also shows a change in the APRA section concern- ing what can be kept confiden- tial. IC 5-14-3-4(b)(1) explains how law enforcement agencies and private university police departments can share inves- tigatory records with crime/ victim advocates without los- ing the ability to protect the records from other records requesters. This same section also says certain law enforce- ment records must be made available under I.C. 5-14-3-5. Section 5 is the "daily log or record" language that outlines what crime reporting informa- tion must be disclosed to the public. This was the battle- ground area over H.E.A. 1022– the Indiana private universi- ties bill that attempted to insu- late their police departments from having to match reporting requirements of all other police departments, including public universities. H.E.A. 1022 was only going to codify what universities must made available under fed- eral law–a significantly lesser amount of information than required under APRA. While the legislature passed H.E.A. 1022, the bill was vetoed by Gov. Mike Pence. So, how did part of H.E.A. 1022 become law? When bills are nearing pas- sage, the Legislative Services Agency (LSA) attempts to make sure language is aligned when more than one bill chang- es a specific section of the law. This avoids conflicts in what was passed. Sections of APRA in H.E.A. 1019 that were also contained in H.E.A. 1022 were modified by LSA in the conference com- mittee report for H.E.A. 1019. This public access to police body camera bill, authored by Rep. Kevin Mahan, R-Hartford City, was passed by both the Indiana House and Senate, and was signed into law by Gov. Pence. So what does this all mean? Public Access Counselor Luke Britt and I agree that the law now says the private university police departments are public agencies. Public agencies fall under the scope of the Access to Public Records Act. We believe private uni- versity police departments should make the same informa- tion available when a crime is reported just like public uni- versity police departments and all other police departments. (Caveat: Federal law does require certain victim informa- tion be kept confidential by all university police departments.) If your beat includes a pri- vate Indiana university with a police department, you still may get resistance on disclos- ing "daily log or record" infor- mation. They may argue that private universities were not included in "such as" list of agency examples under APRA's definition of law enforcement agency at I.C. 5-14-3-2(q)(6). Britt and I agree that rules of statutory construction would not require private universities explicit inclusion in order to fall under the definition. Newspapers who have an interest in covering crime on private campuses should reach out to the university to see that they are creating a "daily log or record" that contains the infor- mation required under APRA at Section 5. The Public Access Counselor's office caught the change while drafting an update for the "Handbook on Indiana's Public Access Laws." I missed it because the changes were not noted in boldface type in the final version of H.E.A. 1019 by the LSA. Meanwhile, the Indiana Supreme Court has taken jurisdiction over the ESPN v. University of Notre Dame lawsuit, which is arguing this point under the law prior to 2016. The Indiana Court of Appeals previously ruled for ESPN that the private univer- sities were subject to APRA. While the law now says you can get more private university police department information, stay tuned for possible changes through judicial decision or leg- islation in the 2017 session.
