Horn's Home and Garden 184 West Trade Street, Forest City 828-245-7505 Website: Hornshomeandgarden.com Email: grow@hornshomeandgarden.com Understanding the Presi- dential Election Process When you vote this November, you will be using the voice that was guaranteed to you by the founders of this country. Whether you support Bernie, Hilary, the Donald, or any number of other potential candidates in the upcoming election, you are taking part in a process that was established all the way back at the Constitutional Convention (a little earlier if you want to get technical). The Constitution sets out the basic framework for electing the President of the United States. While most people know the way the end result is reached, many often miss the little details that get us to that point. For starters, the Constitution sets out certain requirements for the President: at least 35 years of age; native- born citizen; and be a resident of the U.S. for at least 14 years prior. Generally, most of these requirements are not at issue, but you will occasionally here of challenges to the native-born citizen requirement. In recent years, this issue has been raised, albeit unsuccessfully, with candidate Ted Cruz and, previously, President Barack Obama. The right to vote has been heavily contested over the years, and has led to Constitutional amendments, Acts of Congress, and Supreme Court intervention. Interestingly enough, the right to vote was not expressly included in the Constitution. Instead, the Constitution originally allowed for the states to defi ne who was eligible. This led to misuse and, ultimately, the previously mentioned contested actions. In modern terms, the "right to vote" is better understood as a restriction against discrimination on an individuals ability to vote, even though certain restrictions are still allowed. Today, laws concerning voting requirements are still hotly contested. As many North Carolina citizens are aware, new voter ID requirements have been put in place, and, even though later softened, have been challenged in federal court. Another important detail in the election process is that the Constitution doesn't specifi cally call for a general election, and instead relies on the Electoral College. To explain, in November of each presidential election year, each state holds an election that allows eligible citizens to vote for a ticket that includes one candidate for president and one candidate for vice president. The outcome of that vote establishes electors who make the actual choice of president, with each state receiving as many electors as it has senators and members of the House. In December, those "electors" will meet at the state capitol and cast their ballot for president and vice president. In most states, the state requires electors to vote with the popular vote, and that should help explain why you don't hear much about this process. As Thomas Jefferson once said, "the cornerstone of democracy rests on the foundation of an educated electorate." When you head to the polls, you will be faced with a decision that will shape our country moving forward, but it is also important to take the time to educate yourself on the past that has carried us to this point. While the folks at King Law can't help you decide who to vote for in the upcoming election (some would be happy to try), they can help you deal with whatever laws come out of your national or local government. If you have a legal problem in North or South Carolina, don't hesitate to call and schedule your free consultation with King Law at (888)748-KING.
