This article will explore some of the issues common to such situations. In a first marriage, spouses usually want to provide for one another and then their mutual children. In a second marriage situation, spouses often wish to provide for their respective children from their first marriage. Many remarried clients have told me that they wish to provide for their new spouse while he or she is alive, but they desire that the children from their first marriage be taken care of when their current spouse dies. A marital agreement is most important in second marriage situations. Alert individuals will enter into a marital agreement ("pre-nuptial agreement") before they marry a second time. While these agreements can be drafted to meet your individual situation, it is common for each spouse in a second marriage to classify their respective property as their individual property. After such an agreement is signed, individual property will remain the individual property of that spouse as long as it is not commingled or transferred. Each spouse is then free to leave their individual property as they see fit. This enables each spouse to leave their property to their children. Some individuals marry a second time without a marital property agreement. Such agreements are possible even after the parties are already married, although they may be more difficult to negotiate once marriage has occurred. Simple wills can present problems in a second marriage situation. Such wills usually provide that all property passes to the surviving spouse. The expectation is that the children will receive an inheritance only when the second spouse dies. However, most wills are not contractual and the surviving spouse is free to change his or her will after the first spouse dies. The bond between step-parent and step-child is sometimes broken when the first spouse dies, and the tendency is to then exclude the children of the deceased spouse. This can result in the children of the surviving spouse receiving all property at the exclusion of the children of the first spouse to die. Some estate planning techniques to consider in a second marriage situation include leaving your property in trust. Your surviving spouse can be given the income during his or her life, but the remaining principal passes to your children. Another technique is to leave your spouse a life estate in your home, with the home passing to your children when the surviving spouse dies. These and other techniques provide more protection for your children since your surviving spouse cannot change them. In summary, unless you intend to leave everything to your spouse in a second marriage situation, have a written agreement before you marry. Even if you have a written agreement, great care is required to keep assets separate. Under Wisconsin law, no marital agreement is a guarantee against your surviving spouse claiming some unfairness when the agreement was signed or at a later time. The Law Office of James J. Running A brisk walk may benefit your heart just as much as a vigorous run, as long as you burn the same amount of total energy. A new study found that walkers and runners who burned the equal amount of calories had similar reductions in the risk of developing high blood pressure, high cholesterol, heart disease and diabetes. The brisk walking, however, took about twice as much time to burn the same calories as running. Also, runners seem to maintain their weight better in the long term. Experts think this may be because with running there is an increase in the blood levels of a particular appetite-suppressing hormone. 709 W.
