Publisher The Indiana Volume 86, Issue 12 • December 2021 Published monthly Legislation restricting identification of juveniles may be up in 2022 session Legislative update Hoosier State Press Association will propose a bill to modernize the public notice statute (I.C. 5-3-1) to reflect technological changes in how Hoosiers obtain news of their communities. The bill addresses con- cerns raised about the cost of publication of public notices, sets a date certain when notice requirements move from a print to digital requirement, will incorporate a statewide aggregated public notice website into the law, require a sharing of public notices with the Indiana Supreme Court's MyCase platform to aid law- yers and parties, and maintain the crucial elements of effec- tive public notice: accessibil- ity, verification, archivability, and independent source of dis- tribution to insure the integrity of due process and state and local government transpar- ency. HSPA is in the process of talking to legislative leaders about the proposal with the hope of garnering support for its passage. Following are specific items addressed by the HSPA draft that Rep. Ed Clere (R-New Albany) has requested Legislative Services Agency create. Immediate savings for printing of public notices for state and local government units: Any public notice that is required to be published more than once will only be charged at the rate of one publication. This will save those units either 33% or 50% the current cost for publishing notices twice or three times. For attorneys or parties required to publish notices of four common court notices (a sheriff's sale/mortgage foreclosure, opening of an estate, change of name peti- tion, notice of lawsuit or sum- mons) the cost will be capped. Currently, newspapers may charge market rates for these notices. Pauper plaintiffs who need Legislation restricting the identification of juveniles, either those facing a petition alleging juvenile delinquency or those who are victims of crime, may be filed for consideration by the Indiana General Assembly during its 2022 session. The Indiana Public Defenders Council and Accelerate Indiana Municipalities (AIM) informed HSPA of their interest in this diminishment of information that would be made available by Indiana courts and law enforcement agencies. Current law on the trans- parency of juvenile-involved criminal (both victims and alleged perpetrators) cases can be traced to recommendations from the Indiana Juvenile Code and Youth Gang Study Commission following two years of monthly meetings. Then-Gov. Evan Bayh con- vened the Commission "in recognition that the current juvenile justice system in Indiana is not working – at least not as well as it should," according to then- Marion County Prosecutor Jeff Modisett, who was a Commission member. See Public Notice, page 7 HSPA proposing bill that will modernize public notice statute The Hoosier State Press Association has hired Amelia Dieter McClure as government relations counsel. She will work with executive director and gen- eral counsel Stephen Key to forward HSPA's legislative agenda during the 2022 General Assembly and assume the position of executive director upon his retirement. Key, who announced his retirement earlier this year, will mentor McClure as his successor through May of 2022. McClure will then lead the associa- tion as the Indiana newspaper industry continues to adapt to Hoosiers' news consumption needs.
