The EPA sets and changes these standards periodically based on real world conditions and expectations in the market- place, trying to strike a bal- ance between forcing indus- tries to blend renewables into the fuels they produce and al- lowing those industries a real- istic opportunity to remain in business given supply and de- mand in the market. Renew- able fuels include convention- al biofuels like corn starch ethanol and advanced biofu- els like almost anything else. Without delving too deeply into the process of complying with the standards, a compa- ny creates a renewable identi- fication number (RIN) by cre- ating a gallon of biofuel that meets the standard. This in- tangible RIN, once blended with gas or diesel fuel, is sep- arated from the fuel and be- comes able to be used to sig- nify compliance with the stan- dard, traded to another com- pany that needs the RIN to signify compliance with the standard, or banked for use later when that company may need to signify compliance with the standard. Right. As a local example, Valero and Green Plains are in the corn starch ethanol business, so they create a lot of RINs. How- ever, in the case of Valero, the company has a significant oil refinery business in Texas, and the ethanol plant in Mt. Vernon, or its eleven other eth- anol plants, are not going to produce enough RINs for the company as a whole to meet the standard. Valero then pur- chases RINs from the market to make up the difference. The EPA has raised stan- dards for 2022, which will increase demand for biofu- els. Industries that produce biofuels or cre- ate a net surplus of RINs bene- fit from this an- nouncement. In- dustries that buy RINs are not as enthused. Some industries need RINs and cannot stay in business if forced to either produce to buy those RINs. Those indus- tries might be small enough to qualify for a Small Refin- ery Exemption, which allows a company to avoid having to follow the standards. Country- Mark qualifies as a small re- finery and has used exemp- tions in the past. The new EPA announcement includes language about working to de- ny all small refinery exemp- tions. CountryMark used the words "financial ruin" earlier in the year to describe their business without small refinery ex- emption. In this case, the Renewable Fuel Standard chang- es are great for renewable ener- gy companies, like Green Plains. They are a mixed bag for companies with renewable en- ergy refineries and oil refin- eries, like Valero, and they are ruinous for oil refineries, particularly small ones, with no renewable energy compo- nents, like CountryMark.
