25 de Noviembre - 2 de Diciembre, 2021 © El Popular 12A www.elpopularnews.com NOTICE OF HEARING AND SUMMARY OF PROPOSED ORDINANCE SOLID WASTE MANAGEMENT PROGRAM SERVICE CHARGES (GATE FEE AND BIN FEE) FOR NON-RESIDENTIAL PROPERTY On the 4 th day of January, 2022, at the hour of 2:00 p.m., in the Chambers of the Board of Supervisors of the County of Kern, in the Kern County Administrative Center, located at 1115 Truxtun Avenue, Bakersfield, California, a Public Hearing will be conducted to consider the enactment of, and hear any objections to, an Ordinance establishing the schedule of the Solid Waste Management Program Service Charges (Gate Fee and Bin Fee) for all non-residential property in Kern County. This Ordinance will establish a schedule of service charges for non-residential property which will be collected as a Gate Fee or a Bin Fee. The Board of Supervisors will also consider a Report filed by the Public Works Department that describes the amount of the proposed service charge for waste delivered to Kern County waste disposal or transfer facilities for further handling. In accordance with this Report, the proposed basic fee for non-residential waste (Gate Fee) will be increased from $45.00 per ton to $65.00 per ton effective July 1, 2022. A transfer fee of $10.00 per ton will be added to the basic fee for non-residential waste delivered to any Transfer Station effective July 1, 2022. For non-residential customers using bin service from a Franchise Garbage Hauler, the Bin Fee will be increased from $2.34 per cubic yard to $3.38 per cubic yard effective July 1, 2022. A transfer fee of $0.52 per cubic yard will be added if the waste is delivered to a Transfer Station effective July 1, 2022. Additionally, the Kern County Board of Supervisors (Board) may approve future rate adjustments in the Gate Fee and Bin Fee based on the fiscal year Consumer Price Index (CPI) for Los Angeles-Long Beach-Anaheim, CA (Series ID: CUURS49ASA0) without a protest hearing for five years. If, in any year, the rate adjustment approved by the Board is lower than the amount resulting from the application of the CPI, the difference may be carried over and applied by the Board to future rate adjustments. In the event the cited index is substantively changed or is no longer published, the Board will select a substantially similar index. Any affected person may submit a written protest. Written protests must be signed by the objecting party, indicate the subject property and be delivered to the Clerk of the Board of Supervisors prior to the conclusion of the public hearing. Upon the conclusion of the hearing, the Board of Supervisors may adopt, revise, change, reduce or modify any fee set forth in the Report filed by the Public Works Department or overrule any or all objections, and shall make its determination upon each fee as described in that Report. Since solid waste services using a Franchise Garbage Hauler are mandatory in Universal Collection Areas for non-residential customers, the Bin Fee is subject to a Proposition 218 Section 6 process. Should the owners of a majority of the parcels of non-residential properties located in Universal Collection Areas described in the Report object to the report, the report may not be adopted and the Bin Fee utilized for non-residential property described in the report may not be adopted, however, since this increase in the fee is due to a state mandate, further consideration will be required. The Director of the Public Works Department has considered the environmental impacts of this action and concluded that this action is exempt from further environmental review pursuant to California Environmental Quality Act Guidelines Section 15273 and Public Resources Code Section 21080(b)(8) because it is the establishment of operational rates and charges. Additionally, it has been determined that this action is exempt from further environmental review pursuant Guidelines Section 15061(b)(3) because it can be seen with a certainty that this action will not have a significant effect on the environment. In accordance with this report, the Public Works Department proposes to increase the Solid Waste Management Program Service Charge (Land Use Fee) imposed on residential property on the tax roll for Fiscal Year 2022-2023 over the rates established for Fiscal Year 2021-2022. The charge imposed on a parcel of property used as a single-family residence with one to four residential units per parcel will increase from $105.00 per year per residential unit to $180.00 per year per residential unit. Parcels with multi-family dwellings with five or more residential units will increase from $84.00 per year per residential unit to $144.00 per year per residential unit. Additionally, the Kern County Board of Supervisors (Board) may approve future rate adjustments in the Land Use Fee based on the fiscal year Consumer Price Index (CPI) for Los Angeles-Long Beach-Anaheim, CA (Series ID: CUURS49ASA0) without a protest hearing for five years.
