Entre octubre y noviembre (los dos primeros meses del año fi scal de 2021), la CBP expulsó por la frontera sur del país a cerca de 120,000 inmigrantes echando mano del Titulo 42. Tatiana Broff, consultora para temas regionales de Women's Refugee Commission, resaltó que la inadecuada relación en- tre la pandemia, las solicitudes de asilo político y la seguridad fronteriza representa una complicada situación para que la nueva Administración pueda derogar esta regulación. M ientras hacía fi la en la terminal de Greyhound en la ciu- dad de Indio, en el Vale de Coachella, se le acercaron varios agentes federales vestidos de civil, le hicieron algunas preguntas y, poco después, lo esposaron y trasladaron a un centro de detención de inmigrantes. Solano fue puesto bajo proceso de deportación y en esa amargura transcurrieron casi tres años, hasta esta semana, cuando una corte de inmigración de Los Ángeles concluyó que los ofi ciales de Aduanas y Protección Fronteriza (CBP, por sus siglas en inglés) que lo arrestaron en 2018 se basaron en "su apariencia latina" y procedieron pues de forma ilegal. La corte, que ordenó poner fi n a los procedimientos de de- portación contra Solano, dijo en su fallo que, antes de que este fuera detenido, los ofi ciales "solo sabían su nombre, su lugar de residencia y su apariencia", pero que "estos no son factores apropiados para establecer el requisito de sospecha razona- ble". El fallo fue emitido por la Ofi cina Ejecutiva de Revisión de Casos de Inmigración, la instancia donde se apelan las deci- siones de las cortes migratorias, y un órgano dependiente del Departamento de Justicia. "Un ofi cial razonable de CBP debía saber que él o ella esta- ba violando la Cuarta Enmienda [de la Constitución, que prote- ge a las personas contra detenciones arbitrarias] al detenerlo solamente con base en su apariencia latina", dice el fallo. E l reporte presentado en el caso sobre el incumplimiento del Gobierno federal al Acuerdo Flores, que ordena a las autoridades migratorias no tener bajo su custodia a menores inmigrantes más de 20 días y garantizarles acceso a cuidados de salud y bienestar, entre otros, contiene las de- claraciones de varios adolescentes que aseguran fueron dro- gados a la fuerza. Los documentos judiciales contienen el testimonio de un ad- olescente mexicano que ingresó en octubre de 2019 de forma indocumentada al país en busca de refugio. El joven de 16 años le dijo a su abogada en noviembre pas- ado que había estado tomando alrededor de 20 pastillas de medicamento por día, y también habría sido inyectado. "Quiero irme porque cuando me enojo me ponen inyecciones", dijo. Al menos cinco veces le habrían puesto las inyecciones, la última el mes pasado, según describe el alegato. "Cuando me dan una inyección, me entristezco. Y luego duermo por un día. Cuando me despierto después, me siento desesperado. Mi cuerpo se siente desesperado", describe el joven, que vino buscando refugio al sentirse amenazado por pandilleros en México.
