September 2020 Page 10 The following questions were submitted by The Herald Bulletin (Anderson) and the Tribune-Star (Terre Haute), The newspaper is looking into whether the search for a new school superintendent was done properly. I've sent you a link to the notice of an executive session. Would this have allowed the school board to discuss the hiring behind closed doors? I looked over the sample executive ses- sion notice and it is in a proper form. It cites to the Access to Public Records Act provision for executive sessions and lists the specific subject matter that will be discussed, for example, the notice you sent me includes (5) to receive information about and inter- view prospective employees. That subject matter would have allowed the school board to interview school superintendent candidates. While the vote to hire would be required to be held at a public meeting, The school board could have reached a consensus in the executive ses- sion as to who they would be voting on as the new school superintendent. If one public agency has sent a communica- tion to another - local health department send- ing communication to Vigo County School Corp., for example - would that be a pub- lic record on both ends? Health department and VCSC, or on the part of the recipient? Both the county health department and the school district are public agencies under the Access to Public Records Act, so the letter/email/etc. would be a public record for both as long as the sender retained a copy. The question as to access would depend on whether the record is disclosable, confidential at their discretion, or mandated to be kept confidential. Maybe it was setting up a face-to-face with a recalcitrant legislator. Maybe it was making a trip to the Statehouse to act as a sort of "wingman" for Dick so the legislators knew there were folks back home who bought newsprint by the truckload and ink by the barrel who were on Dick's team. Whatever he needed, we did the best to provide. Ultimately, of course, it was Dick's leadership that made the difference. He was the guy who told us where we ought to be going and how he thought we might be able to get there. The great irony of his career is that in persuading government to be more accessible and open to its citizens he made it more credible and trustworthy. Sunshine has a way of doing that. average for over 140 rounds played in 2000, at 67 years old, was 75. His family never tired of hearing his stories of playing golf with Arnold Palmer or Sam Snead. Dick never met a stranger and could strike up a conversation and find common ground with virtually anyone. One of his greatest pleasures in life was meeting new people. He also loved to travel and took the family on summer vacations to every state in the union. Dick and Marcia visited Alaska the year before she passed, and he and his sons recently traveled to Banff, Canada to play Banff National Golf Course; his all-time favorite course. Dick traveled to Banff at least once a decade for a remark- able 8 decades of his life. He is preceded in death by his love, Marcia Cardwell, and they will finally be reunited in heaven, just as he wrote to her after she passed away, "So good night for now Marcia, my beautiful friend, until we stroll together again in heaven, where time has no end." The family held a private internment ceremony on Saturday, Sept. 19 at St. Paul's Episcopal Church. A celebration of Dick's life was held at the Country Club of Indianapolis on Sunday, Sept. 20.
