Maria Luther, owner of the Smiley Barn toy store, said she hopes to have the big smile and its large pair of eyes on the east and west ends of the yellow barn by early August. "We don't have the date pinned down with the con- tractor, yet. We are hoping for the first or second week in August," she told Conley News Service. Meanwhile, she hopes to have the barn painted yellow in July. Luther said the city has notified her that the Common Council will not have to ratify action taken by the Plan Commission last month that will enable her to put the smile back on the barn. Luther was among many people who thought the commission's action had to be approved by the Common Council. Not so, City Planner Roger Dupler said before Monday night's council meeting. Dupler said he con- ferred with City Attorney James Hammes and they both agreed that the com- mission had determined at its May 30 meeting that the big smile was a work of art, not a sign. Therefore, no Common Council action was necessary, Dupler added. The legendary land- mark existed from the late 1970s until the early 2000s when a new owner bought the barn-shaped building and removed the smile. Luther recently pur- chased the building and received permission from the Plan Commission to use thin aluminum fabric and black texture paint to restore the giant smile.
