Simmons said he no- ticed Hitt's vehicle turn in- to a driveway while driving north on Highway 57, then turn around and go south on Highway 57, until it got to the hotel and laundry mat parking lot, where it again turned around and went north on Highway 57. Cpl. Simmons said he followed Hitt's vehicle and noticed it go left of center three times before pulling him over near Lake Minnis Drive. While talking to Hitt, Cpl. Simmons said he noticed slurred and rapid speech, and poor manual dexterity. Hitt failed field sobriety tests and was taken to the Daviess Community Hospi- tal, where he tested positive for methamphetamine, am- phetamine and benzodiaz- epines. Simmons said Pike County Deputy Sheriff Mike Willis conducted an inven- tory of Hitt's 2005 Mercu- ry Mountaineer and found a rubber tourniquet and a cut off straw with a white resi- due, field testing positive for meth. Pike County Deputy Sher- iff Jason McKinney said offi- cers talked to the front seat passenger, Bryan D. Malin, of the same address. McKin- ney's report states when offi- cers asked Malin if he would take field sobriety tests to determine if he could take control of the vehicle, they noticed a partially burnt hand rolled cigarette in the passenger floor board and Deputy Buck Seger smelled synthetic marijuana coming from the vehicle after Malin had opened the door. Officers determined the cigarette was synthetic mar- ijuana and when they asked Malin if there was anything else illegal in the vehicle, he told him there was two grams of K2 (synthetic mar- ijuana) in a potato chip bag, according to McKinney's re- port. The report states Malin told officers he and Atter- bery had bought it at the Evansville Fall Festival and were smoking it on the way back from Evansville. Atterbery was arrested on preliminary charges of oper- ating a vehicle while intox- icated, refusal and posses- sion of synthetic marijuana. Malin was given a summons for possession of synthetic marijuana. Deputy McKinney said Attterbery was allowed to call someone to pick up Ma- lin and her vehicle.
