He replied, "You were looking at me right in the eyes. I thought you had such a sexy look." McDonald in his opening said, "How can someone say, 'I want to rape you again. If they haven't raped her be- fore.'" He added the only reasonable explanation is he had raped her. Roach's attorney Casey Lindeman asked the jury to keep an open mind. "Allow the defendant to have his tri- al. He has a right to cross ex- amine this." He said the jury should look for bias. He said some of the jurors had already been convinced of Roach's guilt. "That is wrong. Open- ing arguments are not evi- dence. You have to have evi- dence to convict." He added the trial was "going to be a mess. We are taking one snapshot out of these people's lives, and picking and choosing what looks best. Don't lose your common sense." Pike County Deputy Sher- iff Brad Jenkins testified he was assigned to talk to the woman, who reported she had a protective order against Roach and he was sending messages to her. "A fter seeing the mes- sages it was apparent a crime had been committed. I spoke to her about it and proceeded from there," said Jenkins. McDonald showed the messages he was referring to: "When I start to take it again you shouldn't fight it." "I love you its more than rape," and, "I love you I want to rape you again." During cross examination by Lindeman, Jenkins said she originally told him the rape had taken place on June 11. However, when Jenkins began researching the case he found her ankle bracelet had been removed on June 21. Lindeman also asked Jen- kins if the woman told him why she had gone to the trailer on a lot on Minnis Trailer Court north of Pe- tersburg. Jenkins said she told him she went there to do some cleaning and taken care of some things. Lindeman asked if she told him she owned it. Jenkins said he didn't re- member if she told him that in the initial interview or lat- er, but she said she was on the deed at some point. Young took the stand and said she had driven out to a trailer at Minnis Trail- er Court to meet Roach be- cause he had promised her he was going to sign over a house trailer and lot to her. She said he had previous- ly added her to the deed, but he had promised if she paid the due taxes on it she could have it. But when she checked the deed, he had just added her to it instead of signing it over to her. She said when she ar- rived she saw Roach stand- ing near the trailer and she got out of her car. "I tried to turn around and go home, but he like pulled me back. I was already tired and he pulled me back. She said Roach knocked her down and she was face down, and he put his knee in her back, pulled her pants down and raped her. Then he tried to do it again, but couldn't. Young said when Roach finally let her up, he then opened the car door for her "like nothing had hap- pened." McDonald then went through the series of posts and text messages with Young. He asked her why she sent a message to Roach. Young said she was hurt and want- ed him to apologize to her, but he never did. "I just tried to deal with it on my own, I didn't want to come to court, but he wouldn't leave me alone." She said she met him, be- cause he lived near her in the trailer court in Peters- burg. "We were friends. We were like cool. I helped him out a lot. I would bring him food and water and drive him where he needed to go," said Young. When cross-examined by Lindeman he asked her if Facebook messages could be deleted. She responded, "Yes." "So prior to going to the land you indicated you were concerned, but you didn't worry about it? " "I didn't say I wasn't wor- ried. He had raped me be- fore and I was in my car. I didn't think he would do any- thing this time." said Young. Lindeman also pointed out during cross-examina- tion there were discrepan- cies as to how many times Roach had raped her. He pointed to messages that indicated it had been three or four times. Young, on the stand, said two times. He also noted Young said she had 'unfriended' Roach. He asked her if she had ev- er added him back as friend? She answered no. Lindeman then showed a friend request to Roach from Young after she had unfriended him. "I don't re- member sending him one," said Young. He also asked her about her relationship with Jeff Johnson, who she lives with. "Do you believe he would be upset if he knew you and Roger were in a re- lationship? " "No, because we were nev- er in a relationship. So why would he be upset? " During closing argu- ments McDonald again said the case is really about what Roach said instead of what Young had said. He went back through the series of messages. A fter repeating the mes- sage from Roach about how he should have raped her, but she had on a tracking home detention bracelet, he asked, "Could this be a consensual encounter? May- be but when you look at the language, this is a message that he is going to sexually assault her." He then repeated the text in which Roach said it was more than rape, he had feel- ings for her. "No, it wasn't rape. I had feelings when I did it. Its more than rape." McDonald then asked, "What is more than rape? " "There is no other reason- able explanation. That one explanation is this man is sadistically enjoying raping her. There is no way in the world you would ever send this, but as a rapist, I guess so," said McDonald. He said 71 times Young came at Roach trying to get him to apologize and he wouldn't. "She is a very in- dependent woman." McDon- ald said the only reason she finally turned Roach in was because of a Facebook post of his that caused people to start calling her a snitch. Lindeman in his closing, pointed out inconsistencies in Young's testimony on the stand and in the deposition before the trial. He said she moved the date of the rape around. She claimed in her deposi- tion she had not been raped before. Then on the stand she said she was raped four times, then three and even- tually twice. He went over some mes- sages she sent to Roach. "I love you," on June 24. "Is that from Roger? No it is from Dwaina." He said another one sent from Dwaina while she was at the jointly owned proper- ty, stated, "Where are you boob? ' On June 27 she sent, "Don't get me pregnant. Are you going back tomorrow? I thought you were staying longer." Another at 3:30 a.m. "I do love you." He said 17 min- utes later she sent, "Stop hanging up on me. I'm not calling back." In another, she thanked him for a compliment about her sexual prowess. "I asked and talked to you about common sense," said Lindeman to the jury in his closing." He added, I high- lighted a few of these mes- sages for you." Each juror was given a copy of the more than 650 messages between the two. Lindeman said he knew it was a tough task for the ju- ry but he added, "I ask you to go back and look at every- thing, and you will find Rog- er Roach not guilty of rape. Prosecutor McDonald in his closing rebuttal told the jury Lindeman had talked about a lot of things, but he couldn't answer the ques- tion he asked about Roach's statements. He said if the case were just based on what Dwaina said, "We wouldn't even be here." "This case comes down to what that man (Roach) said," said McDonald. "Dwaina didn't value her- self as much as we do, but when it happens to one of us, it happens to every one of us," said McDonald. "You can't force someone to have sex with you. I'm telling you to go back there, with every fiber of my being, and find a verdict of guilty." A fter several hours of de- liberation the jury was de- clared deadlocked and could not agree on a verdict. McDonald said on Thurs- day he was reviewing all the options before he decided if he would retry the case.
