The ruling will reduce the original sentence of 50.5 years by at least eight years. The maximum Paquette can now be sentenced to is 42.5 years. Paquette killed three peo- ple on Friday, February 2, 2016, in Pike County while fleeing police, driving south in the northbound lane of I- 69. Stephanie Molinet and Autumn Kapperman were in a Ford Focus driving north. Kapperman was pregnant. Ja- son Lowe and his wife, Saman- tha, of Fishers, were also driv- ing north. Paquette was driving a Chevrolet Tahoe south flee- ing Trooper Hunter Manning, who had attempted to stop him. Pauquette had been driv- ing north in the southbound lane when Manning attempt- ed to stop him, but made an abrupt u-turn and headed south on the northbound lane. He crashed head-on into the Ford Focus driven by Molinet, killing both her and Kapper- man. His Tahoe flipped over and landed on top of Lowe's ve- hicle, instantly killing Jason. His wife, Samantha, survived. According to court records, Paquette told officers while he was being extricated from the vehicle he believed he was being chased by farmers through a field. He was charged and plead- ed guilty to a total of 11 offens- es, including operating a ve- hicle with methamphetamine in his blood, causing a death, and a similar charge for caus- ing injury to Samantha Lowe. He was also charged with reckless homicide, as well as three counts of resisting. He was originally sen- tenced to the 50.5 years in prison on the 11 counts, which was the maximum sen- tence on all counts. However, along with his guilty plea was a stipulation that he could ap- peal his sentence on the three counts of resisting while oper- ating a vehicle causing death. His attorney claimed he should only be charged with one count of resisting, even though three people were killed. He claimed it was one act, and violated a state and federal prohibition on double jeopardy. Pike Circuit Court Judge Jeff Biesterveld ruled against Paquette and sentenced him to 52 years that includ- ed three counts of resisting, causing death. The Court of Appeals re- versed that ruling and or- dered him to be sentenced on one count of resisting. Indiana's Attorney Gen- eral appealed their finding and the Indiana Supreme Court agreed to hear the case again, only considering whether or not to sentence on one or three counts. The Indiana Supreme Court wrote: "We find that Pa- quette could not be convicted of more than one felony resist- ing law enforcement charge where multiple deaths oc- curred from a single act of re- sisting. Because our decision is premised on the statute, we need not conduct a double- jeopardy analysis. Our resist- ing law enforcement statute does not create a new offense for each death that occurs. In- stead, it enhances the under- lying resisting law enforce- ment conviction's degree in circumstances where the of- fense is committed using a ve- hicle in a manner that causes another person's death. With- out explicit authorization for multiple convictions arising out of the same act, we can- not find that Paquette's three felony resisting law enforce- ment convictions can stand. Accordingly, we reverse the trial court as to two of the three convictions for felony resisting law enforcement. Since one of Paquette's other offenses allows for multiple convictions based on a single act of operating a vehicle, we remand for the trial court to enter convictions under that statute for all victims and in- struct the trial court to sen- tence accordingly." No time frame has been es- tablished for when the sen- tencing hearing on Paquette will take place. Pike County Prosecutor Da- rin McDonald said, "It's un- clear whether we have to have a full-fledge re-do of the sen- tencing hearing or the court will be able to re-incorporate the same evidence." He added, "I have noti- fied all of the victims' fami- lies representatives. I have watched them suffer for over two years now with first the horrible crime and then the le- gal process, which can be dif- ficult for victims. I am grate- ful to Tyler Banks and the In- diana Attorney General's of- fice for an outstanding job in advocating for these families. We are obviously disappoint- ed, but will continue to fight for a maximum sentence un- der the legal parameters rec- ognized by the legislature and Indiana Supreme Court.
